FEOC Compliance Assurance
Lion Energy's EMS-C™ platform exceeds current FEOC “Effective Control” guidelines, including those outlined in recent Treasury and IRS notices (such as Notice 2026-15). By maintaining exclusive domestic ownership and governance over hardware, firmware, software, and data pathways, the system avoids any payments, contracts, or IP licensing that could confer effective control to a specified foreign entity or prohibited foreign entity. This design prevents disqualification from relevant clean energy tax credits under sections like 45Y, 48E, and 45X, ensuring full eligibility for customers seeking compliant, secure energy storage solutions amid tightening domestic content and control requirements.
